APPENDIX 1 : 용어(Terminology) ◦ 영문요약서, 특허명세서, 특허청의 통지, 판결 등에 포함되는 용어 중에는 엄격히 구별하여 사용해야하는 것이 많으므로 가급적이면 같은 카테고리에 속하는 것을 통합하여 설명 ◦ 간단한 용어는 영어단어 옆의 괄호 안에 설명을 달았으며, 이들은 경험에 의거하여 설명된 것이기 때문에, 작성자에 따라 선택하여 사용 가능 가. 일반적 용어 - 초록작성시 사용되는 일반적 용어 1) Apparatus - a group or combination of instruments, machinery, tools, materials, etc., having a particular function or intended for a specific use. - 특정목적을 가진 복합적인 기구의 집합체를 의미함으로 단순 도구인 driver, bolt, clamp 등과는 어울리지 않고, 일반적으로 대형의 장치를 apparatus, 소형의 장치나 도구는 device 사용 2) system - A group of interacting, interrelated, or interdependent elements forming a complex whole - 구성요소간의 상호작용이나 관계가 있는 경우에만 3) process, method - process : The steps involved in changing the physical or chemical characteristic of an article or material - A procedure for transforming or reducing an ARTICLE, WORKPIECE or chemical substance to a different state or thing. METHOD, PROCESS and ART means the same thing. METHOD is more common in mechanical and electrical claims; PROCESS is more common in chemical claims; ART today is more commonly used to mean field of technology. - 일반적으로 process와 method는 동의어로서 사용되나, 영문초록 작성시 process는 화학적인 방법에 대부분 사용되고 method는 그 밖의 경우에 사용 4) merit, advantage, gist, effect(모두 이점, 효과), aspect - aspect는 여러 가지의 의미를 가지고 있으며, 명세서에는 “견지”, “면”이라는 의미로 사용 - 방법과 物의 두 가지 claim이 있을 경우, summary항의 claim 대응부분을, - According to one of this invention there is provided a process for manufacturing... - According to another aspect of this invention there is provided apparatus... 로 기재하며, 이를 “본원 제1(제2)의 발명에 의하면”이라고 번역한 예가 있는데 적당한 번역으로 간주 5) function(작용), capability, ability(능력), performance(기능) - function : the kind of action or activity proper to a person, thing, or institution; the purpose for which something is designed or exists; role. : to perform a specified action or activity; work; operate: - capability : the quality of being capable; capacity; ability - ability : power or capacity to do or act physically, mentally, legally, morally, financially, etc. - performance : The way in which someone or something functions - 능력, 기능 등을 나타내는 다양한 단어 중 그 의미가 가장 적합한 단어를 사용 6) illustrate(exemplify), show, denote, Identify, identification, represent(ex. a code representing A), indicative of(= representing) - 모두 “나타내다” 또는 “표현한다”의 의미로 사용하지만, 영문초록 작성에서 illustrate로 기재하면 예시의 의미가 강함 - 다수의 실시예가 있는데 best embodiment를 예로서 나타내는 바와 같은 경우에 illustrate를 사용 - display는 측정 또는 계산 결과 등을 meter 또는 숫자로 표시하는 경우에 사용 - identify는 화합물을 화학식 또는 구조식으로 식별(다른 것과 구별)하는 경우에 사용 7) generally - 대개 “일반적으로” 또는 “통상”으로 번역되나 다음과 같은 용법으로도 번역 - generally designated by reference numeral (전제를 부호 10으로 나타냄) - generally U shaped spring (거의 U자형의 스프링) - generally shown by(or in) Fig. 1 (전체를 도 1로 나타낸) - general view (전체도) 8) alternate, alternative - alternate는 교체이기 때문에 alternating current(교류)와 같이 사용하고, alternative는 대체적인 의미로서, “..하는 대신에 ..할 수도 있다”는 의미 - 예를들어, 실시예에서 황산을 사용한 경우 ‘Alternatively, other organic acids such as citric acid, hydrochloride acid can be used’라고 기재 9) 장착, 고착, 지지를 표현하는 말 - mount는 “고착”은 물론 단지 탑재하는 상태를 나타내는 가장 광범위한 단어로써, “장착”이라고 해석 - secure, fix, fixedly secure은 “고착”이라고 해석 - support는 단지 “지지한다”로 사용 - carry는 본래 “옮긴다”는 뜻이지만 support와 마찬가지로 사용 - journal은 회전자재로 support하는 의미로서, “축지하는”이라고 번역하기도 함 - control은 어떤 미리 정해진 control pattern을 따라서 제어할 때 사용 - adjust는 일정한 치수를 증감하는 경우에 사용 - regulator는 전압을 일정한 값, 예컨대 100V로 유지하고자 하는 경우, 전압이 이로부터 증감하면 일정한 값으로 되돌려 항상 일정한 값을 유지하는 경우를 표시하며, 이와 같은 변화를 deviation(편차)라고 하고, 단순한 difference와 구분하여 사용 - vary(변화) : ex) temperature variation - change(변경) : ex) to change gear - control(제어) : ex) speed controller - adjust(조절) : ex) gap adjuster - regulate(조정) : ex) voltage regulator 10) to hold a roller in position ; to set a plate at angle with respect to the horizontal the resistor is trimmed to value - trim은 가장자리를 자르는 것을 의미하고, trimmed resistor는 얇은 절연물상에 저항재료를 스퍼터 또는 증착하여 길고 가느다란 저항체를 만들고 그 양측의 가장자리를 잘라내어 소정의 값으로 하기 때문에 trim이라는 문자를 사용
