제2절 비특허문헌 이용 현황 본 절에서는 비특허문헌(npl: non-patent literature)을 특허심사를 위해 활용하는 현황을 살펴봄으로써, 주요 국가별로 어떠한 비특허문헌 데이터베이스를 구축하고 있고 필요에 따라 내부 구축이 아닌 외부 전문기관 및 기업의 데이터를 연동하여 사용하고 있는지를 살펴보고자 한다. 이는 최근 지식재산권 데이터의 범위가 논문과 저널 등 출원일자를 소급 인정받을 수 있는 공연한 실시에 해당되는 자료들의 중요성이 높게 인식되고 있는데 선진특허청들은 빠르게 변화하고 있는 신기술 분야의 특허정보가 공개되는 시점이 변화속도보다 다소 늦어 정보 검토시기의 공백이 발생하는 현상이 생기는데 이를 저널이나 논문, 기사 등의 비특허문헌 정보들을 대안적으로 활용되고 있다. 또한, 특허출원시 청구범위나 명세서 상에 기록하는 내용은 비특허문헌에 비해 상세하게 기술되지 않기에 고급정보들이 필요할 때는 비특허문헌들의 의존이 높은 것이 사실이다. 이에 주요 국가들이 심사품질 제고를 위해 살펴보고 있는 비특허문헌 정보들은 어떤 것이 있으며 이들의 정보를 효율적 사용을 위해 내부적으로 구축하여 이용하는 데이터들은 어떤 것이 있는지를 파악하여, 향후 한국특허청에서 고품질의 심사행정을 위해 비특허문헌에 관한 자료가 필요할 경우 참고할 수 있는 정보들이 어떤 것이 있는지를 사전에 검토해 보고자 한다. 비특허문헌에 대해서는 미국특허청, 일본특허청, 유럽특허청, 세계지적재산권기구가 보유하고 있다고 공지한 내용을 토대로 자료들을 취합・정리하였다. 1. 미국특허상표청 미국특허상표청의 비특허문헌(npl: non-patent literature)은 화학, 생명공학, 의학, 전기, 컴퓨터 등 사회 전반의 광범위한 분야에 대해 1만개 이상의 저널들을 보유하고 있으며 특허청 내 인트라넷을 통해 검색이 가능하다. <표 ⅲ-2-1> 미국특허상표청의 비특허문헌 데이터베이스 현황 서비스명 제공자명 건 수 csa technology research db (trd) dialog dialog는 세계 최초의 온라인 정보검색 시스템이자 현재 세계 최대의 데이터 뱅크로 1975년 창립되었으며, 1997년 knight-ridder's사로부터 영국의 maid사가 인수하여 인터넷 웹사이트를 개설하여 제공하였고 2000년 thomson사가 다시 인수하여 비즈니스 분야의 다양한 정보를 약 450여개의 데이터베이스로 분류하여 제공하고 있음 1963 ～ 현재 분야 : materials science, engineering, aerospace, high technology 문헌종류 : journal articles, conference papers, technical reports, books and standards inspec(the database for physics, electronics and computing) daialog 1898 ～ 현재 dialog datastar 1969 ～ 현재 questal orbit 프랑스의 questel사와 미국의 orbit사가 합병되면서 만들어진 시스템으로 약 250개의 데이터베이스를 제공하고 있으며 orbit에는 특허 및 과학기술분야의 정보가 많이 수록되어 있고 questel에는 유럽에 관련된 특허, 과학기술, 통신, 교통분야에 대한 정보가 수록되어 있음 1969 ～ 현재 stn stn(scientific & technical information network) international은 1983년 미국 화학회 산하의 cas(chemical abstracts service)가 중심이 되어 독일의 온라인 정보제공기관인 fiz karlsruhe와 일본의 과학기술정보센터(jicst)가 공동으로 운영하는 온라인 정보서비스임 1969 ～ 현재 분야 : physics, electronics, computing 문헌 종류 : physics abstracts, electrical and electronics abstracts, computer and control abstracts jisct-eplus -
